Project Extension

Project Extension

Delayed timelines are a challenge in real estate, but they don't have to result in legal penalties. AP RERA allows for the extension of project registration under specific statutory provisions, provided the delay is justified.

Understanding Project Extensions

AP RERA allows for the extension of project registration under specific statutory provisions, provided the delay is justified and beyond the promoter's control. Navigating this process requires a deep understanding of the legal framework to ensure your project remains compliant even during delays.

The Legal Framework for Extensions

Section Provision Type Duration & Conditions
Section 6 Force Majeure Extension for the duration of the force majeure event (natural calamities, war, etc.) as determined by the Authority.
Section 6 (Proviso) Reasonable Circumstances Extension of up to 1 year (aggregate) for delays due to government approval bottlenecks or legal disputes, provided no default by the promoter.
Section 7(3) In Lieu of Revocation The Authority may allow a registration to remain in force instead of revoking it, often with specific conditions to ensure project completion.
